But what is the process that must be followed in order to properly authorize a balcony enclosure in a sectional title scheme? It depends on what type of property the balcony is. An owner who wants to enclose a balcony that forms part of his section will need to submit building plans to the trustees for signature before submitting these plans to the Local Authority for approval.
This rule states that an owner must not do anything to his section that is likely to prejudice the harmonious appearance of the building. If the trustees are of the opinion that the enclosure will not prejudice the harmonious appearance of the building then they can sign the plans and if the plans are subsequently approved by the LA then the owner is good to go.
If the balcony does not form part of the section, it is common property. You will be able to tell that the balcony is not part of the section if the solid line indicating the boundary of the section stops before the balcony area on the sectional plan. A common property balcony may be subject to exclusive use rights or may simply be ordinary unregulated common property. The Harmonious Appearance Rule must also be taken into account, therefore the body corporate should consider the harmonious appearance of the building when voting on the special resolution required in terms of section Enclosing a balcony can affect what is known as the Floor Area Ratio or bulk of the property as a whole.
This is a zoning requirement that determines what percentage of the erf may be covered with habitable building space. If there is no bulk left on the property the Local Authority will not approve building plans to enclose a balcony.

There are really only two options here. If it forms part of the common property, it may or may not be subject to exclusive use rights. If the balcony forms part of the section, it will be situated within the solid lines that indicate the boundaries of the section. These two considerations are dealt with later.
The enclosure of a balcony that forms part of the common property, whether or not it is subject to exclusive use rights, will amount to an extension of the section and therefore the provisions of section 24 of the Sectional Titles Act, will have to be complied with. Thus, the extension will need to be authorised by a special resolution of the body corporate, after which the owner concerned will have to arrange for draft section plans of the extension to be drawn up and submitted to the Surveyor-General for approval.
If there is no bulk left for the building, then the local authority will not approve a balcony enclosure. When a balcony is designed to be open to the elements, it is designed differently to the way it would be if it were to be enclosed. An open balcony will often have a sloping floor, water outlet pipes and a single course wall.
It is designed to have rain come in and run out, and it does not really matter if the floor is not waterproof, because the balcony below it is normally also open. But when a balcony is to be enclosed, these aspects will change. So, it is often sensible to impose conditions on any proposed enclosure that ensure that the building envelope will operate properly, for example by requiring that a waterproof membrane be installed, that a cavity wall be built and that the balcony be otherwise properly sealed so that it is waterproof and will not cause unexpected problems for the occupiers of any balcony below.
The fundamental consideration here is whether or not the proposed change will negatively affect the overall appearance of the buildings and thus negatively affect the market value of the sections. This requirement is phrased as an absolute prohibition.
This means that not only is it difficult to interpret — what is considered harmonious or inharmonious is so subjective — but there is also no proper process for getting consensus that a proposed change complies with this requirement.
In practice, when considering an application for a balcony enclosure, an owner and the trustees should get the views of owners in a general meeting as to whether they believe the change would prejudice the harmonious appearance of the building.

Responsibility for the care and maintenance of your balcony varies depending on the circumstances. For example, the weight restriction of your balcony determines what you are able to use it for. As a strata owner, it is your responsibility to check what load it is designed to carry before putting heavy objects on it or having too many guests on it during parties.
Poor water drainage, loose handrails and rust stains can be signs that your balcony needs some repair work done to it and it is your responsibility as a strata owner to monitor the condition of your balcony and report any such maintenance issues to the body corporate. Unless your body corporate is a community land division, it is not your responsibility to pay for such repairs.
These must be carried out by a licensed tradesman and should be initiated and paid for by the body corporate i. Approval can take time however, so be patient.

The liability for a defective balcony usually lies with the body corporate. For example, if a balustrade is too low and you injure yourself falling from your balcony, the body corporate may be liable if the balustrade was not built to code at least one metre high or if they were aware it was unsafe and did nothing to rectify it. As far as the ongoing maintenance and cleaning of your balcony is concerned, responsibility also depends on which part of the balcony requires maintenance or repair.

Sometimes this barrier is nothing more than a railing, but many times it is a waist-high concrete block wall. If you want to enclose your apartment balcony, you will need to build walls and a roof to enclose the entire project, providing privacy and a greater level of comfort within a controlled environment.
The balcony base is the most important part to any enclosure, because before you can build any walls or a structure on top of the balcony base, you must first ensure that the base is strong enough to support what you want to put on top. Consult a structural engineer knowledgeable about city building codes and the building's architect, if possible, to determine whether or not you need to make additional shoring steps to further strengthen the base of your balcony. In most cases, balconies are built strong enough to handle some basic framing weight added on top, but always check first so you don't have any accidents down the road with the balcony falling out from under the weight.
If your existing balcony walls reach to about waist height, you can probably tie in to the existing walls and continue the installation up to the roof. However, if there are merely railings of some sort, these will have to be ripped out first so that you can build your own walls. An existing basic block wall enclosing a balcony is the perfect platform for wall framing to continue up to a roof. From here, you can mount wall framing with bolts and then attach a roof to the top of the wood frame.
Existing wood frames are also acceptable as a platform as long as they follow the traditional framing rules with vertical studs set at inch intervals.
From there you can just add new wall framing and work your way up to the chosen height of your enclosure. A balcony enclosure is not the same structure as a full-size house that has an extremely heavy roof or even a second level above it. In short, the walls of the balcony enclosure do not support tons of weight, but they are still limited in some aspects because they are part of the balcony, which means the support of the balcony as it juts out from the building is the support you have to work with.
Although some enhancements can be made to shore it up, the best option for balcony enclosures is to use wood framing, just like wood is used in a typical home. Full-height block and brick walls are too heavy to be considered for the walls of a balcony, because they would put too much weight on the base. After you have framed the walls and the roof of the balcony, you have to tie it in to the existing siding of the building so that you can ensure everything remains waterproof.
Install flashing and guttering around all of the perimeters, and also install flashing underneath the wall siding of the building where it meets the new roof of the balcony, and down under the layer of shingles or other roofing material you use to cover the balcony.
These could be asphalt shingles, clay or concrete tile shingles, or raw natural stone shingles. Everything needs to be waterproofed, flashed and tied in to the existing siding for waterproof protection.
Protect the exterior of the balcony by installing some type of siding material. The same principles apply as when siding a home, so you can use the same type of materials, such as vinyl strip siding or wood shingle siding. You can also opt for metal siding or for wood panelling. Tie in any new siding with the existing siding of the building via flashing that underlies each separate material.
